If you signed a short-term loan agreement yesterday and have thought better of it, you are probably still in time. The right to cancel a Texas payday loan is real, short, and one of the few consumer protections in this market that costs you nothing to use.
Quick answer: Texas rules generally allow you to rescind a payday loan by the close of the next business day after you enter it, without penalty, by returning the full amount advanced. Confirm the exact window in your agreement, return the funds in a traceable way, and get written confirmation that the loan is void.
How the window works
The rescission right exists so a borrower who signed under pressure is not locked in. In broad terms: you may cancel by the close of the next business day, you return the full amount that was advanced to you, and no fee or interest is owed.
Three details decide whether it works in practice.
- Business day, not calendar day. Sign on a Friday afternoon and the window typically runs to the close of Monday. Sign the day before a holiday and it extends further. Do not assume; ask.
- Full amount advanced. Returning most of it does not cancel the loan. If you have already spent part of the money, you generally cannot rescind.
- The agreement governs the detail. Your written contract must state the cancellation terms. Read that clause before you rely on a general rule.
This is separate from the El Paso ordinance protections. Chapter 5.17 caps how much you can borrow and how long the debt can run; the rescission right lets you undo the transaction entirely within the first day or so.
How to actually cancel, step by step
- Find the clause. Open the loan agreement and locate the cancellation or rescission section. Note the exact deadline it states.
- Contact the business in writing. A phone call is fine to start, but follow it immediately with an email or text saying you are exercising your right to cancel, with the date and the loan number. This is the record that matters if there is a dispute.
- Return the full amount traceably. Cash in person with a signed receipt, or a method that leaves a record. Never hand over cash without documentation.
- Get the cancellation confirmed in writing and keep it. Ask specifically that any post-dated check or bank authorisation be returned or voided.
- Watch your bank account for the next two cycles to make sure no debit is presented anyway.
If the business refuses, do not argue in the store. File a complaint with the Texas Office of Consumer Credit Commissioner, which licenses and supervises every credit access business in the state. In El Paso you can also raise it with the City, which enforces Chapter 5.17 and can inspect the three years of records the ordinance requires.
What the right does not cover
Rescission undoes the loan. It does not undo everything around it, and a few limits catch people out.
- It is not a cooling-off period on the money. Spend part of the advance and you generally lose the right, because you cannot return the full amount.
- It does not reverse a third-party charge. If you already paid a bill with the funds, that transaction stands on its own terms.
- It is not a defence to an earlier loan. Cancelling a new advance you took to cover an older one leaves the older one exactly where it was.
- It does not apply retroactively to renewals. The window runs from the agreement you are cancelling.
Use it for what it is good at: the loan you signed under pressure yesterday, whose funds are still sitting untouched in your account.
If the window has already closed
Past the next business day, cancellation is off the table but the debt is still manageable, and the important thing is to act before the due date rather than after.
- Ask about an installment arrangement. In El Paso, repayment can be structured over no more than four installments, each retiring at least 25% of the principal.
- Understand the renewal limit. Three renewals maximum in El Paso, each cutting principal by at least a quarter. The debt cannot run indefinitely, but each renewal generally carries its own fee.
- Price a payoff. A credit-union small loan or a Payday Alternative Loan capped at 28% interest often costs less than continuing. GECU and First Light Federal Credit Union both serve El Paso.

And remember the boundary that applies whatever happens: Texas bars a lender from pursuing criminal charges over a check given for a payday loan except in cases of actual fraud. Non-payment is a civil matter, and a threat of arrest is itself grounds for a complaint.
Avoiding the situation next time
The rescission right is a safety net, not a plan. Two habits make it unnecessary.
First, never sign at the counter on the same visit you first walk in. Take the written fee disclosure home, read the total cost of credit, and come back. A business that discourages this is telling you something.
Second, price one cheaper option before you go. In El Paso that means a credit union, an employer hardship fund — the school district, the hospital systems and other large employers generally have one — a payment plan with El Paso Electric or a medical provider, or Texas 211’s El Paso County assistance listings.
